Human rights and the lawyer

Human rights, or fundamental rights, are a concept according to which every human being has inalienable rights, regardless of the legal system they are subject to, and regardless of other locational factors such as ethnicity, nationality or religion. Irrespectively of the social status, these rights are inherent in every human being and must therefore be opposable to society and power.

Some rights, like the right to life, or the right to human dignity, or the right to a fair trial, are intangible, and their violations are prohibited in all circumstances. Other rights, such as the right to freedom of thought, conscience and religion, the right to private property, or the right to freedom of expression, may be subject to restrictions. However, these restrictions should not only be always prescribed by law, but also be proportionate. They can neither be justified by a conflict with the fundamental rights of others, nor by an overriding public interest.

Often, these restrictions are perfectly legal and even indispensable to the social order. Often too, they are invisible because they are part of our daily lives. We all know, for example, that we cannot insult at will whom we please. This restriction to our right to freedom of expression is both lawful and proportionate.

Still, it is precisely when these restrictions are imperceptible and - due to their imbrication in legislation and regulation - difficult to identify, that they may be the least justified.

Violations of human rights are recurrent in our contemporary society. They can affect any individual who, faced with a problem, may be unaware that an unwarranted violation of a fundamental right might be the cause of it.
